Welcome to the Alain Locke Charter School (“Alain Locke”) website. Alain Locke (“we” or “us”) is the owner of alainlocke.org/ and facilitates the operation of the website on alainlocke.org (referred to later as the “Site”). Alain Locke is deeply committed to protecting the privacy of the individuals who visit us online at the Site. In order to provide transparency on how we handle the information of users who visit the Site, we have created this Privacy Policy. This Privacy Policy (referred to later as this “Policy”) describes our practices regarding the collection and use of information throughout the Site.

Please read this Policy carefully before using this Site. We will treat any information we collect from you through this Site in accordance with this Policy. 

By accessing or using this Site, you consent to all actions taken by us with respect to your information in compliance with this Policy. If you are unwilling to accept the terms and conditions of this Policy, please do not use this Site.

We may update this Policy from time to time to reflect changing technology, laws or other factors. We will notify you of changes to the Policy by posting the updated Policy on this page. Your continued use of this Site after we make changes is deemed to be acceptance of those changes, so please bookmark and periodically review this page to ensure that you remain familiar with the most current version of the Policy. WHAT THIS POLICY APPLIES TO

This Policy applies to information only to the extent it is collected through this Site (including in e-mail, text, and other electronic messages between you and this Site) or offline via hard copy forms that you fill out and return to us.

You do not need to take any action as a result of this Policy, but if you are based in the United Kingdom or the European Union, you should also refer to the section headed “Additional information for visitors in the United Kingdom and the European Union”, for a description of additional information and rights that you may have. If you are a resident of California, you should also refer to the section headed “Notice to California consumers of certain rights under the CCPA”, for a description of additional rights specific to California residents.

This Policy does not apply to information to the extent it is collected through any other means, including any other website operated by us or any third party.

GENERAL WEBSITE ACCESS

You are not required to provide any personal information whatsoever in order to access our website. However, Alain Locke does utilize software to measure web users’ activity on an anonymous basis for insights on user engagement, which web pages are viewed most often, and a variety of other aggregated analytics that can help improve the user experience.

OUR COMMITMENT TO DATA SECURITY

Unfortunately, the transmission of information via the Internet is not completely secure and we cannot guarantee the security of your Personally Identifiable Information transmitted to or through the Services; any such transmission is at your own risk. 

“Services” means this Site along with any and all content, features, functionality, and services offered on or through this Site. 

PERSONAL INFORMATION WE COLLECT

The Site collects two basic types of information during your visits to our Site, Anonymous Information, and Personally Identifiable Information.

Anonymous Information. We collect non-Personally Identifiable Information (“Anonymous Information”). This is general information that cannot be traced to individuals and contains no personalized data–think of it as a simple census form. When visitors come to our Site, we collect and aggregate information indicating, among other things, which pages of the Site were visited, the order in which they were visited and which links on the Site were clicked by visitors. We use this information in making modifications and improvements to the Site to provide you, the user, with both a smoother and more efficient user experience.

We also use non-invasive “cookies” and other tracking technologies to collect Anonymous Information, which we then use to provide you with an easier user experience. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your Web browser. These cookies do not track other websites you might visit and they do not plant malware on your computer. Our non-invasive cookies simply make it possible for us to recognize your browser once you visit our Site. By doing this, we can personalize your return visits and save you time during checkout. Your browser must be set to accept cookies in order for you to enjoy the benefits of being a registered user of the Site. Some internet browsers have incorporated “Do Not Track” features. Most of these features, when turned on, send a signal or preference (the “DNT Signal”) to web sites you visit indicating that you do not wish to be tracked. 

The Site uses Anonymous Information, such as your IP address and the pages that you visit on our Site, to help diagnose problems with our servers and to administer our Site and improve Site-related services and features. Your IP address and other Anonymous Information also may be used to gather broad demographic information and to recognize customer traffic patterns and Site usage trends. This information aids us in developing the design and layout of the Site.

Personally Identifiable Information. We collect Personally Identifiable Information as needed to provide our Services. In general, our Site uses a student application form, and a registration form so that you can request information and Services from us. “Personally Identifiable Information” means your or your child’s name, street address, telephone number, e-mail address, credit card number, or user or account name or number, health information or any other piece of information provided by you to us that, individually or when combined with other personal or identifying information, allows the identification of a person or is otherwise considered Personally Identifiable Information or personal data protected under any applicable law. 

Please take some time to familiarize yourself with the different ways that the Site uses the information that we gather.

Keep in mind that, while we encourage all third parties that might have access to data from our Site to adhere to our policies regarding the privacy of our visitors and to handle Personally Identifiable Information in a responsible manner, we cannot and do not assume any responsibility for any actions or omissions of third parties, including the manner in which they use information received either from the Site or independently.

Use of Personally Identifiable Information. The Site uses Personally Identifiable Information collected from you to complete transactions initiated by you, particularly the submission of student applications and donations. Your Personally Identifiable Information is also used to get in touch with you when necessary regarding questions about any submission you might make. We may also use Personally Identifiable Information to contact you to make sure you are satisfied with our Services or to find out how we can serve you better. 

Financial information (credit card numbers, credit card expiration dates, billing address, and so forth) is used solely to bill you for donations, products and Services. We use a third party processor to conduct such transactions, and we do not have access to, nor do we store, any of your financial information.

SECURITY AND RETENTION OF PERSONAL INFORMATION

We adopt robust and appropriate data security technologies, measures and policies, so the Personally Identifiable Information we have about you is protected to the extent possible from unauthorized access and disclosure, improper use and accidental loss. In addition, we limit access to your Personally Identifiable Information to those employees, agents, contractors and other third parties who have a business need to know and who need to know that Personally Identifiable Information. They will only process your Personally Identifiable Information on our instructions and they are subject to a duty of confidentiality and required to keep your Personally Identifiable Information secure.

We have put in place procedures to deal with any suspected Personally Identifiable Information breach and will notify you and any applicable regulator of a breach where we are legally required to do so. We will keep your Personally Identifiable Information only for as long as is reasonably necessary for the purposes set out in this Policy, unless a longer retention period is required by law. We will not keep more Personally Identifiable Information than we need for those purposes. CHANGING OR DELETING YOUR PERSONALLY IDENTIFIABLE INFORMATION

You may update or request deletion of the Personally Identifiable Information that you previously submitted to us by contacting us at vfoster@alainlocke.org.

EMAIL AND FORM SUBMISSIONS

You may decide to send us Personally Identifiable Information by sending an email or completing an online form in order to learn more about Alain Locke, such as how to submit a lottery application for your child’s enrollment. In order to receive communications from Alain Locke, you first must opt in to our subscriber list, and can opt out at any time. No Personally Identifiable Information submitted on alainlocke.org/ is ever sold to third parties outside of our organization without your prior consent.

ACCURACY OF INFORMATION PROVIDED BY YOU

You represent and warrant that any information that you provide in connection with your use of the Site is and shall remain true, accurate, and complete, and that you will maintain and update such information as needed. You agree that if any information you provide is false, inaccurate, obsolete or incomplete, we may terminate your use of the Site.

REVIEWS, COMMENTS, SUBMISSIONS AND OTHER COMMUNICATIONS

Alain Locke welcomes your reviews, comments and other communications (“User Content”), as long as the User Content submitted by you complies with this Policy. The Site does not endorse, recommend or sponsor any User Content.

You agree that any User Content submitted by you on the Site will be accurate, will not violate or facilitate the violation of any applicable law, regulation or Site rule or policy, will not violate any right of a third party, including, copyright, trademark, privacy or publicity rights, and will not cause injury to any person or entity. You agree that User Content submitted by you on the Site will not contain threatening language, and will not contain malware, political campaigning, commercial solicitation, chain letters, mass mailings or any form of “spam”. In addition, you agree that you have not been compensated nor granted any consideration by any third party for the User Content submitted by you.

You are solely responsible for the User Content you submit, and neither this Site nor Alain Locke assumes any liability for any User Content submitted by you. You agree to indemnify us against all claims and liabilities resulting from your User Content. You acknowledge and agree that we reserve the right (but have no obligation) to do any or all of the following, at our discretion: (i) monitor User Content; (ii) alter, remove, or refuse to post or allow to be posted any User Content; and/or (iii) disclose any User Content, and the circumstances surrounding their transmission, to any third party in order to (a) operate the Site; (b) to protect Alain Locke and its employees, officers, directors, affiliates, agents, representatives, licensors, suppliers and service providers (collectively, the “Alain Locke Entities”), and the Site’s users and visitors; (c) to comply with legal obligations or governmental requests; (d) to enforce this Policy; or (e) for any other reason or purpose.

In consideration of your use of the Services, you agree that Alain Locke shall own all User Content and associated intellectual property rights, whether provided orally or in writing, and you hereby assign all right, title, and interest (including all intellectual property rights) that you have or may have in User Content to Alain Locke, and agree to take such actions and to execute such documents as reasonably requested by Alain Locke to confirm, convey, record, or otherwise effectuate Alain Locke’s sole ownership of the User Content. In addition, you grant to Alain Locke the right to include the name provided along with the User Content submitted by you; provided, however, Alain Locke shall have no obligation to include such name with such User Content. Please note that, if you use your name in connection with your User Content, this Personally Identifiable Information will become public information, and will be available to Site visitors and to the general public; moreover, such Personally Identifiable Information, once so disclosed to the general public, may be redistributed through the Internet and other media channels, where it will reach an even broader audience. We are not responsible for the use or disclosure of any Personally Identifiable Information that you voluntarily disclose in connection with your User Content. 

You must provide your actual e-mail address in order to submit User Content. Any content you submit will be routed through the Internet, and you understand and acknowledge that you have no expectation of privacy regarding User Content. By submitting your e-mail address in connection with your User Content, you agree that Alain Locke and its third party service providers may use your e-mail address to contact you about your User Content and for other administrative purposes; provided, however, Alain Locke has no obligation to respond to any User Content.

For all User Content posted by you, you represent and warrant that you have all rights necessary for you to grant the licenses granted in this section, and that such User Content, and your provision thereof to and through the Site, comply with all applicable laws, rules and regulations. You further irrevocably waive any “moral rights” or other rights with respect to attribution of authorship or integrity of materials regarding User Content that you may have under any applicable law under any legal theory.

User Content is also provided by third party visitors to the Site. Please note that Site visitors may make statements, post messages or other User Content that are inaccurate, misleading or deceptive. Alain Locke and its affiliates, partners, suppliers or any other associated entities neither endorse nor are responsible for any opinion, advice, information or statements made by third parties. Alain Locke and Alain Locke Entities are not responsible for any such information or materials made available through the Site (including errors or omissions in postings or links or images embedded in such postings) or results obtained by using any such information or materials. Under no circumstances will the Alain Locke Entities be responsible or liable for any loss or damage caused by your reliance on such information or materials. The opinions expressed by third parties reflect solely the opinions of the individuals who submitted such opinions and may not reflect the opinions of Alain Locke.

The Alain Locke website may contain links to other websites. When you click on one of these links, you will be transferred out of our Site and connected to the website of the organization that you selected. Please be aware that we are not responsible for the privacy practices, nature, quality or accuracy of the content or opinions expressed on these websites. Inclusion of any linked website on this Site does not imply or express an approval or endorsement of the linked website by us, or of any of the content, opinions, products or services provided on these websites. CHILDREN’S ONLINE PRIVACY PROTECTION ACT (COPPA)

This website is not directed to children under the age of 13-years-old.  Alain Locke’s policy seeks to ensure our organization does not knowingly collect any Personally Identifiable Information from children under this age, including “individually identifiable information” as defined by COPPA. If you are under the age of 13, you should leave this website without filling out any forms or otherwise providing information about yourself. We require that all information about any child under the age of 13 provided through our forms comes from such child’s parent/guardian, or with the parent/guardian’s verified consent.  If Alain Locke were to knowingly collect Personally Identifiable Information from children under the age of 13, it would be done so in accordance with COPPA. If we learn we have collected or received Personally Identifiable Information from a child under the age of 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under the age of 13 that was provided without parental consent, please contact us by sending us an e-mail stating your request to vfoster@alainlocke.org or contacting us in writing at Alain Locke Charter School, 3141 W. Jackson Blvd, Chicago, IL 60612. 

By providing Personally Identifiable Information through this Site, you represent and warrant that you are either over the age of 13 or have gotten parental consent as laid out above. If you do not meet these requirements, you must not provide Personally Identifiable Information through this Site.

NOTICE TO CALIFORNIA CONSUMERS OF CERTAIN RIGHTS UNDER THE CCPA

This section outlines specific rights granted under the California Consumer Privacy Act (the “CCPA”) to individual California residents and provides information regarding how such California residents can exercise their rights under the CCPA. This section is only relevant to you if you are a resident of California as determined in accordance with the CCPA. Information required to be disclosed to California residents under the CCPA regarding the collection of their Personally Identifiable Information that is not set forth in this section is otherwise set forth in this Policy. For the avoidance of doubt, for purposes of this Policy, references to personal data or Personally Identifiable Information are deemed to include references to “personal information” and “sensitive personal information” as defined under the CCPA.

We do not sell or share (as such terms are defined in the CCPA) any of the personal data we collect about you with third parties. We have not in the last 12 months, sold or shared any personal data collected with third parties.

We do not collect or use sensitive personal information other than to perform the services, or provide any goods, as would reasonably be expected by an average consumer who requests those goods or services. 

  • Deletion Rights: You have the right to request that we delete any of your personal data that we retain, subject to certain statutory exceptions, including, but not limited to, our compliance with U.S., state, local and non-U.S. laws, rules and regulations. We will notify you in writing and provide an explanation if we cannot comply with a specific request.
  • Disclosure and Access Rights: You have the right to request that we disclose to you certain information regarding our collection and use of personal data specific to you over the last twelve (12) months. Such information includes:
  • the categories of personal data we collected about you;
  • the categories of sources from which the personal data was collected;
  • our business or commercial purpose for collecting the personal data;
  • the categories of third parties with whom we share the personal data;
  • the specific pieces of personal data we collected about you; and
  • whether we disclosed your personal data to a third party, and, if so, the categories of personal data that each recipient obtained.

CONSENT TO INTERNATIONAL PROCESSING

Your Personally Identifiable Information may be transferred, stored, or processed on computers located outside your state, province, country or other jurisdiction. As a result, your Personally Identifiable Information may be subject to data protection and other laws that may differ from your country of residence, and such privacy laws may not be deemed as protective as those in your jurisdiction. By using the Services or submitting information to us, you agree to the transfer, processing, and retention in the United States and to other applicable territories in which the privacy laws may not be as comprehensive as, or equivalent to, those in the country where you reside and/or are a citizen with the use of safeguards as required under applicable law.

YOUR RIGHTS

  • Access: You have the right to ask for a copy of the personal data that we hold and process about you free of charge, however we may charge a ‘reasonable fee’, if we think that your request is excessive, to help us cover the costs of locating the information you have requested. 
  • Correction: You have a right to request that we correct your personal data if the information we hold and process about you is inaccurate or it needs to be updated.
  • Deletion: If you think that we shouldn’t be holding or processing your personal data any more, you may request that we delete it. Please note that this may not always be possible due to legal obligations. 
  • Restrictions on use: You may request that we stop processing your personal data (other than storing it), if: (i) you contest the accuracy of it (until the accuracy is verified); (ii) you believe the processing is against the law; (iii) you believe that we no longer need your personal data for the purposes for which it was collected, but you still need your personal data to establish or defend a legal claim; or (iv) you object to the processing, and we are verifying whether our legitimate grounds to process your personal data, override your own rights.
  • Object: You have the right to object to processing, including: (i) for direct marketing; (ii) for research or statistical purposes; or (iii) where processing is based on legitimate interests.

We may also contact you to ask you for further information in relation to your request to speed up our response.
